Major Provisions of SB1070 Overruled
Well, I'm going to stop making predictions. I predicted Sunday on my hub "Some Political Musings" that the major provisions of SB1070 would be kept intact by Judge Bolton. Today, that Clinton appointed judge proved I should not quit my day job. Judge Bolton ruled today that she would accept the federal government's injunction for SB1070which now prohibits law enforcement from inquiring about a person's immigration status. The judge also delayed a provision requiring illegals to carry their papers on them at all times. The judge also made it illegal for law enforcement to carry out warrantless arrests of suspected illegal aliens.
There's little good to say about Judge Bolton's position on illegals in this country. Mexico has become the de facto government entity when it comes to Mexicans illegally in this country. I was astonished when the Mexican government intervened in a domestic issue (SB1070) of a sovereign nation (well, supposedly sovereign). But, not a peep came from our government about this illegal intervention by Mexico. Either America has the right to outlaw illegal immigration or it doesn't. I don't see where Judge Bolton could justify her decision based on the fact the federal government is doing nothing to stop illegals from coming to this country. Arizona is overrun with illegals taking advantage of social programs in that state. It is an intrusion on the rights of the state to protect its citizens from illegals. One Arizona rancher has already been murdered on his ranch from an illegal earlier this year. How many more Americans have to be murdered before we finally decide to protect ourselves? How many states will have to declare bankruptcy before someone finally says enough is enough in regard to illegals?
I now wait with baited breath for the Obama Administration to go after sanctuary citiesin this country who are in direct violation of federal law. It is the very height of hypocrisy that Obama goes after Arizona, but ignores sanctuary cities like Dallas, Houston, San Francisco and many others. It's all about the Obama agenda. He is willing to forgo border enforcement until Republicans (and the majority of Americans for that matter) accept his amnesty agenda. Never mind the burden that illegals cause this country. It's all about the Obama single mindedness to get another voting block for the Democratic Party. Nothing else matters to him. When does it end? It's tough to say. George W. Bush is as much or more to blame, for our woes with illegal immigration today, than anyone else. He had eight years to bring it under control. I still don't understand that man. I doubt I ever will.
Here's a little something I'm sure you have seen in email before. This is an abbreviated version:
If you cross the Venezuelan border illegally you will be branded a spy
and your fate will be sealed.
If you cross the Mexican borders illegally you will jailed for two years.
If you cross the Cuban border illegally you will be thrown into political
prison to rot.
If you cross the United States border illegally you get:

3 - A Social Security card
4 - Welfare
5 - Food stamps
6 - Credit cards
7 - Subsidized rent or a loan to buy a house
8 - Free education
9 - Free health care
10 - A lobbyist in Washington
11 - Billions of dollars in public documents printed in your language
12 - Millions of servicemen and women who are willing to - and do - die
for your right to the ways and means of our constitution
13 - And the right to carry the flag of your country - the one you walked
out on - while you call America racist and protest that you don't get
enough respect.

Isn't it a sad state of affairs. As an employer, if everyone was just required to use Everify, it would eliminate the ability for anyone to get a job if they didn't have legal status. And it is easy and quick to use--suprisingly enough for a federal program.
Lots of Tea Party people are doing just as you say. The Glen Beck event this month will be another watershed moment in taking this nation back from those who intend to turn us into "Republican of Northern Mexico." I can't condone burning any national flag, not even the Mexican flag. In fact, I wish the Mexicans would continue to wave that flag at their protests. It only infuriates people more. This includes the people who hold the power in this country; the moderate center.
This does not surprise me at all. It is going to take the majority to stop being so civil and "silent". We can rag all we want on these boards and such but what we really need to do is gather about 100,000 or so people across the country and gather at the White House protesting this Obamanation. Maybe burn a few Mexican flags. Can't throw us all in jail can they? Or, come to think of it, if the rest of the states just up and pass laws similar to Arizona's what are the Feds going to do...sue they all? Send the military in to stop them?
SaMcNutt, that talk about the Mexicans being "hard working" is just another liberal flat out lie. As you pointed out, why don't they work hard and change their corrupt government? The reason they come here is apparent; free medical care, free education, free jobs, no taxes and free SSI checks for the anchor babies. They come here and work for slave wages. In doing so, they hurt the higher wages of Americans. None of that matters though. What matters is that they are a potential voting block for the pro(re)gressives.
Almost any country I know of does not tolerate illegals. I also wonder why, if these illegal immigrants from Mexico are here, are still so proud to be Mexican? If they were truly patriotic, wouldn't they stay and try to make their own country a better place to live. One cannot say that the 'government of Mexico is corrupt and that's why they are leaving' because that empowers the corruption. If one has a love for their country they stay and fight for that country and they try to change the things that are wrong with it according to their ability.
The other thing that concerns me about the Federal Governments response to Arizona's laws is it is encouraging slavery by diminishing the involvement of police in discovering who is here illegally. How some of the illegals get here is by force and they are put into modern-day slavery known as the flesh trade. Often these individuals are taken from their homes in Mexico, and other places and forced to work on farms in order to pay off a family members debt, etc. The police's efforts could go a long way in interviewing those here illegally in discovering if they are here because of a situation like this.
We allowed this to happen when African tribes sold their prisoners to Slaveholders way back when, now we have a slave class another way with a different face and name. Slaves in the south were given food, shelter and maybe even decent clothing, but the fact remains, history would still call them slaves. There is little difference in my eyes.
Sheri, I guess I should not have been surprised since it was a Clinton appointee. But, I really felt, in my amateur opinion, that SB1070 was on solid constitutional ground. It almost mimics the 1986 law which is a federal law on the books that is not being enforced.
Sheila, it was gutted for all intents and purposes. But, thankfully, Gov. Brewer is in this for the long haul.

As you said, a Clinton apointee----no real surprise how she ruled. Of course, when the 9th circuit in San Fran Sicko gets finished with it, this won't even be recognizable.

Yo are right about Obama. He is relentless when he sets his sights on something even if it is not in the best interests of the people of this nation. Just look at the moratorium in the Gulf.

It surprised me in that the Arizona law was modeled after the 1986 Immigration Reform and Control Act. That is a federal law that is not being enforced. Judge Bolton, for reasons only she can explain, did not take that into account. In fact, SB1070 was not as strict as the 1986 law. I would like to see what precedents she used to issue an injunction. It is ridiculous that states cannot protect themselves from invaders because the federal government is not willing.

I suspect it will go to the U.S. Supreme Court also. But, even if we get a decision there upholding the AZ law, Obama has shown no reluctance to impose a new law when he see's a ruling he doesn't like.
This will go to the Supreme Court. The government may feel victorious for the moment but it will be short lived. The suit was very unpopular with most Americans.
this surprises you. Not me. the Fed has a long history of stepping on states and personal rights. Like Islamic extremists, the illegals and mexico have flat out stated their intentions for years. its a proxy war to retake the southwest. they teach it in schools, they shout it at rallies here in the US. La Raza makes no secret of it. and the sheeple of America just shrug and say oh it cant happen here.
it wont end till People get fed up and throw them out and throw out the Traitors on the Hill as well, that pass bills for votes and money.
side note.. dont just blame GW, add in clinton, Bush 41 and Reagan, who signed an Amnesty bill himself. its a travesty.

tdarby, E-Verify works too well. That is why La Raza wants it outlawed. I think we have been going about illegal immigration issue all wrong. Sure, I would love to see the estimated 25 million deported. But, realistically, the best thing is if they self-deport. Take away the carrot of jobs, and they will leave. Next thing to do is do something about the anchor babies.
