Arizona Takes the Initiative
Arizona Governor Jan Brewer signed the nation's toughest and strictest illegal immigration bill today. It prohibits anyone from another country to be in the state of Arizona illegally. Police now can question anyone about their immigration status. Arizona officials estimate there are approximately 460,000 illegal aliens in the state. President Obama has instructed the Justice Department to see if this bill is on legal standing. He further stated "... the recent efforts in Arizona, which threaten to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and their communities that is so crucial to keeping us safe."
I find it odd the President would make a comment about a bill that he is not sure is on legal standing or not. Well, after his "police acted stupidly " comment last year, perhaps I should not be. Regardless. like so many states, Arizona is overwhelmed by the huge numbers of illegal aliens who have disregarded U.S. laws and swamped social services paid by U.S. taxpayers. The federal government doesn't even have to pass "comprehensive immigration reform " to help state governments combat illegals. All the federal government has to do is enforce the law that is on the books. The 1986 Immigration Reform and Control Act gives the federal government all the enforcement powers it needs to fight this threat to national security. However, due to open borders proponents and businesses taking advantage of cheap labor, the federal government has been reluctant for decades to enforce the law.
I believe Hispanic groups, such as La Raza (which gets federal funding, by the way), do not want any laws enforcing border security. Their agenda is to flood the United States with new Democratic voters who will wipe away any conditions on immigration to this nation. If you give mass amnesty to the twenty million illegal aliens in this nation, that will just present us with a new problem of more mass illegal immigration. I simply don't understand how Democrats and Republicans don't recognize that. Now, I don't have a problem with someone trying to better him or herself. America is and always will be the land of opportunity. It is not the land of social services and free education for the world. Not yet anyway. We have a front door. There are many people who have immigrated to this nation the legal way. They are doing it right by waiting their turn. But, you have these millions of illegals taking advantage of every social service they can, who now want "amnesty ." They don't really want to become U.S. citizens, in my opinion. All they want is to work without fear of arrest, take advantage of social services and schools. Other than that, I feel most really don't care about this nation. Now, that may be painting them all with a very broad brush. I concede some may not feel that way. But, the fact is all that are in this country illegally, have broken U.S. law. Now, they want to be "compensated " for it.
Unfortunately, I don't believe the Arizona immigration bill is going to hold up in court. The accusation of "racial profiling" is going to weigh heavily in any court decision. I fear there will be an injunction against this bill sometime this weekend or early next week. The Hispanic lobby is very powerful. The charge of "racism" is a tool that they use very well. Many Democrats and Republicans cower in fear of it. Or, God forbid, they will be called a "nativist" . Whatever. It has nothing to do with race and they know it. The United States of America is a sovereign nation. We have laws that have to be upheld and enforced. We have a border just as all other nations of the world have in their respective countries. Why shouldn't this nation be allowed to enforce our borders? I would like just one illegal alien apologist to answer that question for me.
One day, I fear more than anything, al-Qaeda is going to sneak across the southern border all the material they need for a "dirty bomb." Most likely, they will come across as "illegal immigrants" searching for a better life. If this scenario takes place (most likely in a sanctuary city), the issue of border security will then become irrelevant. I say irrelevant because the deed will be done. It will be too late to address the issue of illegals coming into this country in waves. It will be too late for blackmailing Congressmen to add blanket amnesty in "comprehensive immigration reform." If that terrible day comes, what will you illegal alien apologists have to say then?

vrajavala, it most certainly does mirror the 1986 Immigration Reform Act. What is going to be curious is if the federal government will have to intervene if a court finds the law unconstitutional. What does that do to the 1986 law? It will be interesting.
good hub. I don't thjink it's the toughest immigration law in the USA. Kris Koch,one of the authors of the bill said that the bill simply parallels already existing federal law.
Mike, I tend to believe these officers are going to be thoroughly trained on probable cause in this instance. What makes you believe they won't? Sure, there are bad apples in everything in society, even law enforcement. Are we to ignore the law because a minority group MIGHT be detained wrongfully? If that is the case, then we must extend this courtesy to every facet of law. Then what? We have complete anarchy because no law can be enforced due to "not being sure."
People get detained wrongfully every single day in this country. Is it because of racial profiling in each instance? No. And, yes, there are bad apples in law enforcement. Are we to exempt minorities because they might be racially profiled? I'm just extending your argument to what I feel is it's logical conclusion. Basically, you seem to think in order to keep people from being wrongfully detained (hispanics), we should just repeal our laws guarding our border. Is that what you want? The law doesn't say all illegals are hispanic. But, who are the majority of illegals in this country, Mike? I think you know. To ignore that is beyond all reason.
SEO, you hit the nail on the head. There are many hispanic police officers who will be enforcing this law in Arizona. Now, just because a police officer is white, is he automatically committing racial profiling? The very accusation is racial to start.
The problem is there are no exact guidelines governing probable cause. Therefore, a police officer can use just about any reason to stop and question a person, delaying their business or freedom to move about. I agree with you, most officers are wonderful, responsible servants of the people. However, as in almost every group, there are a few bad apples who will abuse this additional power. Otherwise law abiding citizens will be subject to containment and possible harassment because of the color of their skin or the way they speak. If you think this is okay, I would suggest you re-read the US Constitution. There are better ways to curb illegal immigration than to step of US citizens civil rights. Think about it. Please.
My comment is concerned mainly with Latinos because they are the ones who will be most affected in Arizona.
I believe the majority of police officers in Arizona WILL honor the "reasonable" suspicion clause. What might reasonable suspicion be? I would guess undue nervousness or fleeing when the police are sighted would be two of them. There are a good many Latino police officers throughout Arizona and the majority of Arizonans are NOT racist against Latinos. In fact, in some areas, you'd be hard pressed to find a white person. The problem is with illegal immigrants and NOT immigrants. If anyone is worried about being stopped and asked for documents, either they should hike it back across the border or carry ID and recognize the real reasons behind the law: the PROBLEM of illegal immigration. I truly hope this law sticks, works the way it is meant to work, and encourages other states to follow suit.
Polly, you hit the nail on the head in regard to both parties. They both have their own selfish reasons for wanting to keep illegals in this country. This is the very reason I have advocated a third party in this country for a long time. Even Glen Beck has got into the act. He said he is against amnesty. But, he is for letting them get in back of the line toward citizenship. These people don't want to be citizens. They want a) to be able to work here for slave labor wages, undercutting American salaries. b) take advantage of all our social services, free education and, of coure, free healthcare courtesy of the illegal alien in the White House.
Well I wrote the hub "Who doesn't know what illegal means?" and I am not going to get into republican or democrat because for some unknown reason they both want them here. My beef is all they do get when we have American citizens in need and I found out the hard way they were right in my college class when I was writing about them and I used an article from the LA Times putting them down,talking about them burning our flag...other things... not even my words! and the school demanded my professor give me an F. I ended up the class with an A but I know now we are all getting F'd.
Nancy, I tend to believe they will try to overturn it because the argument will be made that there is no way AZ can prevent racial profiling. To my knowledge, the 1986 Immigration Reform Act did not address this issue. I had been thinking if the court overrules AZ, then the Justice Department would have to step in on the side of AZ since the very blueprint for SB1070 IS that 1986 federally enacted legislation.
Excellent article and your signs say it all concerning the 1986 amnesty and the fall out, we are experiencing now. I believe Arizona's SB1070 will hold up since it mirrors the federal immigration laws. Sad that our government panders to a group of lawbreakers yet turns the laws of our country against its own citizens...In my opinion, that is the worst kind of discrimination...

Illegal immigrant (or illegal alien) doesn't specify hispanic, oriental, European or whatever. Illegal means illegal. We are a country of laws. You don't get to pick and choose which laws you want to obey. Either the law is there for a reason or it isn't. I'm not sure how else I can explain that to you. There are terrible laws in Mexico for illegal immigrants. Mexico has the right to protect their border. So, tell me, why can't the USA also have that right? It just so happens that most illegal immigrants are hispanic. To deny that is to deny all logic. We don't have a big problem with illegal Polish immigrants or Canadian immigrants. Why is that?
And, yes, if you keep up with the news you would know that 73% of illegal immigrants are utilizing some form of social services due to "anchor babies."
I don't get your point about Spanish food. I can live without it. The Statue of Liberty doesn't say anything about giving me your tired, worn out illegal immigrants. It doesn't say anything about people who wish to break U.S. laws are welcome here. You are reading into that what you wish. Again, the USA has a right to have borders just as Mexico, Guatemala, Honduras, Brazil, Poland, England and on and on. We are a country of laws. Respect our laws and you are welcome. Disrespect our laws, as illegal aliens do every day by being here, and you get the reaction of the recent poll showing over 70% of Americans supporting the Arizona anti-illegal immigration bill. Illegals are not special. They should get in line with the other people wanting to come to this country the legal way.

Wayne, that was excellent! Only thing I would add is that it is time for Americans for sovereignty to take the gloves off. Many are afraid of the racist and nativist label. This isn't about race, color or creed. They know this. They also know that people cower in fear when you label them a racist. The open borders crowd use the race card often and early. Good write, David. A very powerful subject and an excellent argument on your part. For many years, we have been too polite. Now we just tip-toe around touting our political correctness. I, for one, am sick of it. I see two things protecting illegals in this country. One is their downstream status as potential voters and the other is the way they fit into big business in America. I don't think illegals end up in Greeley CO working at a meat packig plant without help from this side. That needs to be dried up. If you can't make a buck legally, get the hell out of business. newwoman53, I have no doubt about the North American Union. I sincerely believe that was a goal under George W. Bush. He just got exposed on it with his advocating amnesty for illegals. The amnesty fight may be over this year, if we are to believe what is now being said by Sen. Graham and Reid stating he backtracking and pushing for climate change. But, I think it would be a good idea to keep a close watch on things. Arizona is going to be a testing ground for the leftwing on pushing for this agenda.

I think all of this is linking up with The One World Order and the North American Union. They have been well on their way towards this far longer than most people realize.
LRC I personally think the racial profiling and "civil rights" of illegals are the only two issues they have a leg to stand on right now. Like it or not, they are breaking the law each day they are in this country illegally. In WWII, how did we discover who were German spies and who were German immigrants? Some rights have to be infringed unfortunately in order to enforce the laws of this country. The fact these illegals are taking jobs away from millions of unemployed Americans and legal immigrants should bother every sensible person in this country.
What do you do when you catch them? If someone is in this country illegally, make it a felony offense. That way once they are deported (after time in prison...3-6 months at a tent city in Texas or AZ should suffice), make it known they can never be allowed back in the country and can never become a U.S. citizen because they are felons. That would get the attention of a lot of people in this country illegally. We have to take drastic measure, LRC. People forget we are still at war with an enemy that will sink to any level to destroy this country. Our border with Mexico must be sealed. If not, the terrible scenario I painted in my hub could very well take place. I appreciate your comments. Interesting.
In the case in Arizona, there will be a lot of questions about whether this new law violates civil rights. If the state of AZ thinks they are broke now, wait until the lawsuits come piling in. The challenge is how do you determine by looking at someone whether they are "illegal immigrants." Besides, what do they do when they actually catch someone? It seems like right now they are rounded up and shipped back to the country where they came from...only to sneak back over again.
I don't have the answers but I know we need something more comprehensive that addresses the problem. I think all of us posting here agree that we can't allow people to flood into this country illegally. The challenge is to find a way to actually stop this from happening (or more likely, curb it)
commisioner, I agree with you. But, we have a president who had total disdain for the constitution and especially the 10th amendment. I will be pleasantly surprised if it holds up in court. What bothers me is Mexico getting involved in a domestic issue. If we did that to Mexico, they would be asking the UN to sanction us.
i personally hope it holds up if for no other reason in a court as for the right of sovereignty of the state of arizona. the constitution actually gives certain rights to the state over and above federal rule. such is the genius of our founders.
LRC, good points. I said in the hub I didn't think the bill would hold up in court due to AZ not being able to settle the issue of racial profiling. That alone would win in a court of law. It's not fair to this country to take on all the low-skilled, poor of other countries. That sounds terrible, I know. But, my sympathies lie with the 15 million unemployed Americans, the same people that the pro-illegal immigration supporters say won't do the work that the illegals do. Interesting article and I agree with you for the most part about the threats and troubles of those who come to this country illegally. While most illegal immigrants come here looking for work, we can't ignore the fact that it is a national security breach, no doubt about it. Unfortunately, Arizona is trying to be forward thinking but Obama is right. The new AZ law is really difficult to enforce, as the Governor herself could not explain how it could be properly enforced. Most likely it will simply open up Arizona for a large number of lawsuits before it is eventually found to be unconstitutional. Even though most people in AZ were for the bill, the AZ police were not. I think they understand the difficult situations it will put them in.
Sheri, I was amazed at that 70% number. I am willing to wager there are a large segment in that percentage that are hispanics as well. Of course, Obama once again get himself involved in local and state politics. He just can't help hmself.
I heard that 70 percent of the citizens of AZ support this law. GREAT!!! I agree, this is another ploy to get as many illegals here to vote for BO as possible in 2012. There is legal immigration. I get confused about the problem Doesn't the word "illegal" mean AGAINST THE LAW??? Sorry, I sometimes forget that America has been "fundamentally transformed". I live in Arizona so this subject hits very close to home for me.
I wonder if anyone would change their opinion if this was their own back yard that was being invaded. They would wake up to huge piles of trash, feces, dirty diapers, and sometimes dead bodies every morning. They would spend all day cleaning up their yard, only to have it repeated that very night. They would have a serious injury or illness with a family member, and head to the ER with all their insurance information, only to wait for hours because the room was full of illegals seeking free medical care.
Profiling is an interesting issue that really upsets the latino population in Arizona. If the police were notified that a 4' tall green man was recorded on video robbing a bank, the police would not be targeting whites, blacks, hispanics, or any other race. They would be concentrating their efforts looking for 4' tall green men. It's odd how people take it personal when it comes to profiling.
